Right to Clean Air

clean air  Article 21 of Indian constitution states that,’ No person shall be deprived of his life or personal liberty except according to procedures established by law.’ Concept of human rights has been a part of the constitution since independence but the right to clean air has never been which now is emerging as an important concept. Every person, from the snippet of his introduction to the world, acquires certain rights.  One of which is the right to live in a cleaner and healthier environment.

A healthier air is the fundamental part of the right to life for everyone living on the planet. Violation, therefore, of the right to clean air is potentially a violation of the basic right to life. The real panic was only felt after the Bhopal gas tragedy that happened in 1984. Soon after this, India concentrated on the problem of pollution. If a person is able to breathe a cleaner air and is not suffering from any health hazard that means he is not denied any of his fundamental rights. Air is an indispensable gift of nature for preservation of life. The main motto of social life is to live in harmony with nature so destruction of nature means destruction of mankind. Earlier environment was considered as an inseparable part of one’s life. However, now man’s needs have been changed, he has started exploiting the resources. He has been transformed from preserver to destroyer.

A dirty air has different harmful chemical variants like carbon dioxide, hydrocarbons, sulphur, nitrogen dioxide etc. An unhealthy environment actually interferes with person’s living life in dignity. Therefore, In Indian Context, the boundaries of the fundamental right to life and personal liberty guaranteed in Article 21 were expanded to include environmental protection. The air which people breathe is of poor quality because of pollution all around in the environment. A need then arises wherein we need to have reliable and cost efficient green systems that make the air cleaner and less polluted.
